Yofo Membership Agreement Terms & Conditions

1. Tips and instructions

  1. Yofo Mutual Aid Platform is initiated and organized by Yofo Solutions Pvt. Ltd. (hereinafter referred to as "Yofo Internet Company"). The public welfare concept of "All help me I help all" is a network mutual aid platform established to help the broad masses of the people realize the protection desire of "care for illness and support for illness". Yofo Mutual Aid Platform is committed to building a mutual aid mechanism for major diseases, accidents, and other related mutual aid among members. After meeting the joining conditions, you can become a Yofo Mutual Aid member, and by joining a specific mutual aid plan, you can obtain mutual aid rights and fulfill sharing obligations.
  2. The Membership Convention is an agreement signed and followed by all members including you and the Yofo Mutual Aid Platform. Before you join the Yofo Mutual Aid Platform, please carefully read and fully understand the entire content of this Membership Agreement, especially the bolded part. If you have any questions about the content of this Membership Agreement and the prompt information on the page, please do not proceed to the next step. You can email support at support@yofo.com for consultation in order to obtain explanations and instructions. By clicking on the page or confirming by other means, you agree to this membership agreement.
  3. When a mutual aid member who suffers from cancer/major disease and meets the conditions for mutual aid, other members participating in the same plan have the obligation to provide mutual aid to him. The mutual aid plan is NOT an insurance policy, and the Yofo mutual aid platform is not a commercial insurance company, and the Yofo mutual aid platform does not promise that you can obtain certain risk protection. Members have to wait for 270 days from the day of enrollment before they can make any claim to ensure that they didn’t had any pre-existing serious health problems. Please note, that the mutual Aid contribute is not an insurance premium and is a voluntary contribution. Members' apportionment of mutual aid funds is a one-way gift, and the amount of gift apportionment that has been completed cannot be withdrawn or revoked. The final amount of mutual aid applicants for mutual aid is based on the actual donations of other members of the same plan. The Yofo Mutual Aid Platform does not guarantee or promise the amount of mutual aid applicants for mutual aid, nor does it undertake payment obligations.
  4. 2. Definition

  1. Membership: collectively referred to as registered members and mutual aid members.
  2.  Registered member: refers to a natural person or legal person who has full capacity for civil rights and civil conduct, fills in the real identity information on the Yofo mutual aid platform and completes the registration process. Registered members become mutual aid members of a mutual aid plan after joining a certain mutual aid plan of the Yofo mutual aid platform, and only mutual aid members have the right to receive aid.
  3.  Mutual aid members: refer to registered members who join the mutual aid program of the Yofo mutual aid platform or other natural persons who join the mutual aid program on behalf of registered members. For minors and other persons without or with limited capacity for civil conduct, their guardians shall exercise the rights and fulfill obligations of mutual aid members on their behalf.
  4.  Mutual aid plan: refers to a collection of mutual aid members based on the principles of mutual aid and plan terms. Mutual aid members in the same mutual aid plan enjoy mutual aid rights and perform mutual aid member obligations according to the terms of the plan.
  5.  Mutual aid event: refers to the occurrence of events stipulated in the terms of mutual aid plan among mutual aid members, such as accidents or cancer/major diseases.
  6.  Mutual aid fund: refers to the pre-deposited and recharged funds and the fruits generated by the mutual aid members in the account of the Yofo mutual aid platform, which will all be used for mutual aid plan assistance and related expenses arising from the assistance.
  7.  Mutual aid fund: refers to the mutual aid funds received by mutual aid members from other mutual aid members of the same plan when a mutual aid event that meets the mutual aid conditions occurs.
  8.  Mutual aid conditions: means that the conditions for joining the mutual aid plan and the terms of the plan are met, and there is no situation of non-existence of mutual aid.
  9.  Platform activities: Refers to activities other than the mutual aid plan initiated by the Yofo mutual aid platform.
  10. Mutual aid applicants: After a mutual aid incident occurs, the mutual aid member should handle the mutual aid application himself. If a mutual aid member dies or cannot handle the mutual aid application in person due to special reasons, the mutual aid member's legal heir shall be the mutual aid applicant.
  11. Joining the plan on behalf of others: refers to the member who, under the premise of obtaining the consent and authorization of others, joins the mutual aid plan on behalf of others in his own Yofo mutual aid platform account and assumes the mutual aid funds that should be deposited and recharged by others and the mutual aid funds that should be apportioned. Management fees and other related costs.
  12. Management fee: refers to the fee charged by the Yofo mutual aid platform for organizing and managing the business activities of the mutual aid plan. The management fee is subject to the specific terms or pages of the mutual aid plan.
  13. Balance: refers to the part of the sum of the apportioned amount actually collected in the current period exceeding the mutual aid fund, management fee and other related expenses in the current period.

3. Constitution and revision of the Convention

  1. The terms of the Mutual Aid Program and the articles of association, rules, and systems published by the Yofo Mutual Aid Platform are important components of the Membership Agreement and have the same legal effect as the Membership Agreement.
  2. You understand and agree that the Yofo Mutual Aid Platform may make adjustments to this Membership Agreement in accordance with changes in laws, regulations and regulatory policies, or to provide you with better services and experiences. You will be notified of the adjusted Membership Convention through announcements or other means. If you do not accept the adjustment, you can withdraw at any time; if you do not choose to withdraw, it means that you agree and accept the adjusted membership agreement.

4. Rights and Obligations

  1. As a registered member, you have the following rights and obligations:
    • You have the right to browse the mutual aid plan and platform activity information announced by the Yofo mutual aid platform.
    • You have the right to participate in various mutual aid programs or platform activities initiated by the Yofo mutual aid platform.
    • You are obliged to provide true and accurate identity information to Yofo, and promise that all the materials you provide are true, accurate and complete; you agree and authorize Yofo to check and confirm the identity information you submit through third-party channels. Authenticity, accuracy, completeness, legality.
    • You are obliged to ensure that you do not publish fraudulent, illegal, pornographic, obscene, violent and other content that violates national laws, regulations and policies on the Yofo Mutual Aid platform, and do not publish offensive or insulting remarks.
    • You have the obligation to pre-deposit and recharge mutual aid funds and share mutual aid funds, management fees and other related expenses on the Yofo mutual aid platform. You should regularly check the balance of each mutual aid plan in the platform account, and recharge in time when the balance is insufficient. Yofo mutual aid platform will also send you a reminder of insufficient balance through the WhatsApp/Email. When the account balance of the mutual aid member platform is lower than the minimum value stipulated in the terms of the mutual aid plan, you will lose the right to be aided, and you will not assume the mutual aid obligation.
    • You are obliged to keep an eye on the WhatsApp official account of "Yofo Mutual Assistance", and check and read the push messages such as event announcement notifications, project pending notifications, and insufficient balance reminders pushed by the WhatsApp official account in a timely manner. If you fail to receive the above message due to unfollowing/blocking the WhatsApp official account of "Yofo Mutual Aid" or other non-platform reasons, you may not refuse to perform the obligations agreed in the mutual aid plan or require the platform to bear any responsibility on the grounds that the message has not been delivered.
    • When you join the mutual aid program on behalf of others, you should agree and promise that you have obtained the consent and authorization of others. The other person's information filled in is true, accurate and valid. Fully inquire and understand the health conditions of others, inform them of their participation in the mutual aid plan and related rights and interests, and confirm that their health meets the health requirements; fully inform and confirm that others agree to the membership agreement (including but not limited to the terms, regulations, rules and systems of the mutual aid plan) and other documents); bear mutual aid funds that should be deposited and recharged by others; authorization should be obtained when exercising rights on behalf of others.
    • You have the right to apply for withdrawing from the mutual aid plan you joined yourself and the mutual aid plan you joined on behalf of others. If you apply to withdraw from the mutual aid plan joined on behalf of others, you should obtain the consent and authorization of others; you agree to handle disputes with others by yourself, Yofo Mutual Aid Platform does not intervene in disputes between you and others. All losses, claims and complaints arising therefrom shall be borne and resolved by you, and Yofo Mutual Aid Platform shall not bear any responsibility for this.
    • The Yofo Mutual Aid platform account is for your own use only, and shall not be authorized by any third party to use it through transfer, loan or gift. When registering, binding and associating with the Yofo mutual aid platform account, you should use your own real and valid identity information and contact information, including but not limited to ID card, WhatsApp account, bank account, mobile phone number and email address, etc.; you should ensure that the identity information of mutual aid members filled in on the Yofo mutual aid platform is true and valid, otherwise mutual aid members will not be able to obtain mutual aid and any rights enjoyed by mutual aid members based on the membership agreement.
    • You should properly keep the user name and password of the Yofo mutual aid platform account (including but not limited to mobile phone dynamic passwords, etc.). Please do not give OTP to anyone eve if they claim to represent us. Responsibility rests with you.
  2. As a mutual aid member, on the basis of the rights and obligations of registered members, you further enjoy the following rights and undertake the following obligations:
    • You are obliged to provide mutual aid to members who meet the mutual aid conditions in the same mutual aid plan, and you also have the right to receive mutual aid from other members in the same mutual aid plan when you meet the mutual aid conditions.
    • You have the right to obtain membership services provided by the Yofo Mutual Aid platform, view your own participation in the mutual aid program records, understand the mutual aid events you participated in and share, and question the authenticity of the mutual aid events.
    • In the event that members or mutual aid applicants obtain mutual aid funds by providing false materials and information, you agree to immediately transfer the right to request members or mutual aid applicants to return the mutual aid funds to the Yofo mutual aid platform without signing a separate written authorization or transfer of rights document. Yofo Mutual Aid Platform will claim the return of mutual aid funds from members or mutual aid applicants through legal channels and return them to your platform account.
    • You have the right to suggest and supervise the mutual aid plan of the Yofo mutual aid platform.
    • You agree and authorize the Yofo mutual aid platform to accept mutual aid applications, review the mutual aid application materials, and determine whether the mutual aid event meets the mutual aid conditions.
    • When other mutual aid members of the same mutual aid plan meet mutual aid conditions, or judicial administrative agencies such as people's courts/arbitration institutions determine that Yofo Mutual Aid Platform should perform the payment of mutual aid funds in the form of effective legal documents such as judgments/mediation letters/awards Or when assigning mutual aid obligations on behalf of you, you agree and authorize Yofo Mutual Aid Platform to transfer the corresponding amount from your platform account for mutual aid allocation. Special cases that have been judged by the court, adjudicated by the arbitration institution, or mediated by the court or the arbitration institution shall be publicized after the relevant legal documents become effective. Publicity does not accept reports, and the publicity will be distributed after the expiration of the publicity period.
    • If you join multiple mutual aid plans on the Yofo mutual aid platform, if you lose the mutual aid membership of any one of the mutual aid plans due to insufficient balance, the membership rights of other mutual aid plans you participate in will not be affected (except for association/upgrade plans) .
    • If you fail to fulfill the mutual assistance obligation once due to non-platform reasons, it is deemed that you have automatically withdrawn from the mutual assistance plan. If you rejoin the mutual aid plan after withdrawal, the waiting period will be recalculated.
    • You are obliged to provide materials and prove the authenticity of the mutual aid event and compliance with the mutual aid conditions. The proof materials you provide should comply with the terms of the mutual aid plan.
    • After the mutual aid event occurs, in order to facilitate the unified management of the mutual aid event, you agree and authorize the Yofo Mutual Aid platform to verify the mutual aid event on behalf of the designated third-party evaluation agency, and you agree with the verification conclusion issued by the third-party evaluation agency.
    • Mutual aid members and mutual aid applicants agree and authorize the Yofo mutual aid platform to disclose to all members their identity information, diagnosis and treatment information, the process and details of mutual aid incidents and the materials provided by the mutual aid application, and agree and authorize third-party evaluation agencies, Platform employees or other members of the platform organization will check and visit them.
    • If you fail to properly fulfill your mutual assistance obligations, or have any behavior that damages the legitimate rights and interests of the Yofo mutual aid platform and other members, the Yofo mutual aid platform has the right to terminate your account, password or use of the service, and has the right to ban your use of the Yofo mutual aid platform. Any content remaining during the service process shall be removed or deleted, and at the same time, it has the right to terminate some or all of the services for you.
    • If you find that any organization or individual has violated the membership agreement, you are obliged to notify the Yofo mutual aid platform in time.
  3. Yofo Mutual Aid Platform enjoys the following rights and undertakes the following obligations:
    • Yofo mutual aid platform has the right to formulate various mutual aid plans and initiate member mutual aid.
    • Yofo Mutual Aid Platform has the right to review the mutual aid application materials of mutual aid members, and judge whether members can obtain mutual aid based on the audit results.
    • Yofo Mutual Aid Platform has the right to manage mutual aid funds recharged by mutual aid members, and has the right to charge management fees and other related fees.
    • The Yofo Mutual Aid Platform is responsible for formulating and revising platform documents such as conventions, mutual aid plan terms, articles of association, rules, and systems, designing member joining processes and mutual aid application processes, and reviewing mutual aid application materials. It is not due to intentional or gross negligence of the platform The platform does not bear any responsibility for the loss of members.
    • Members or mutual aid applicants who defraud mutual aid funds by providing false materials and information, tampering, falsifying or concealing data and information, etc., will lose their mutual aid membership and will be permanently prohibited from joining the mutual aid plan of the Yofo mutual aid platform. If the Yofo Mutual Aid Platform has initiated mutual aid and allocated mutual aid funds, the Yofo Mutual Aid Platform has the right to recover the mutual aid funds through legal means on behalf of all mutual aid members in the name of Yofo Company and return them to the members who participated in the current mutual aid sharing.
    • When the Yofo Mutual Aid Platform cannot continue to operate due to objective reasons such as changes in national laws, regulations or policies, or the number of members of any plan, the Yofo Mutual Aid Platform has the right to adjust all or part of the mutual aid plan. The adjustment measures include but it is not limited to adjusting the maximum mutual aid amount, optimizing the existing mutual aid plan or terminating the mutual aid plan. If the mutual aid plan is terminated, the mutual aid plan will become invalid from the date when the termination decision is made, and there will be no retrospective effect on the shared mutual aid events. Except for the balance of rewards) all will be refunded to the members, but the apportioned mutual funds, management fees and other related expenses will not be returned.
    • Yofo Mutual Aid Platform has the right to adjust all or part of the mutual aid plan according to the needs of management. The adjustment measures include but are not limited to splitting, integrating and terminating the mutual aid plan. Members can choose whether to accept the adjustment or not according to the situation. If they do not accept the adjustment, they can apply to the Yofo mutual aid platform to withdraw from the mutual aid plan. If the member continues to participate in the adjusted mutual aid plan, it means that the member agrees to and accepts the adjusted mutual aid plan.
    • In view of the fact that a sufficient number of members can ensure the stability and sustainability of the mutual aid plan, the Yofo mutual aid platform has the right to formulate a member incentive plan. The methods of motivating members include but are not limited to increasing the maximum mutual aid amount of members by completing invitations or other tasks.
    • If you withdraw from the Yofo Mutual Aid Platform for any reason, the Yofo Mutual Aid Platform shall return the account balance of the member platform (except the balance given or rewarded by the Yofo Mutual Aid Platform) through the original payment channel, but will not return the apportioned mutual aid funds and management fees and other related costs.
    • The Yofo Mutual Aid Platform is an online mutual aid platform. Any disputes between members participating in the mutual aid, except for mutual aid incidents, have nothing to do with the Yofo Mutual Aid Platform, and the Yofo Mutual Aid Platform does not bear any responsibility. If a member publicly insults others or fabricates facts to slander others or Yofo Mutual Aid Platform, or engages in other malicious attacks and other inappropriate behaviors, Yofo Aid Platform has the right to refuse to provide services to the member and has the right to require the member to compensate Yofo Aid Platform, other All losses of members and third parties.
    • Yofo Mutual Aid Platform has the right to immediately close or delete the member’s account and all related information and files in the account when it finds any improper behavior by the member, and temporarily or permanently prohibit the member from continuing to use the aforementioned files, accounts or services.

5. Mutual aid funds, management fees and balances

  1. As a registered member, you have the following rights and obligations:
    • Share mutual aid funds, management fees and other related expenses;
    • Communication costs for contacting members;
    • Mutual aid funds, mutual aid funds, management fees and balances and other funds transfer and funds deposit costs;
    • Expenses incurred by member supervision (including but not limited to travel expenses, etc.)
  2. As a mutual aid member, on the basis of the rights and obligations of registered members, you further enjoy the following rights and undertake the following obligations:
    • Relevant fees for case verification and review;
    • Relevant expenses incurred in litigation, arbitration, notarization, etc.;
    • Related expenses such as information collection, sorting, screening, and online publishing;
    • Risk assessment, mutual consultation, online dispute resolution and other related expenses;
    • Fees for the necessary review of membership qualifications and authenticity of information;
    • Costs for the necessary review of the authenticity and legality of mutual assistance events;
    • Expenses for continuous network mutual aid knowledge popularization and risk education activities;
    • Internet information content management and related costs of network and information security management;
    • Fees for supporting the sustainable operation and development of the Yofo Mutual Aid Platform;
    • Other necessary and reasonable expenses.
  3. Yofo Mutual Aid Platform enjoys the following rights and undertakes the following obligations:
    • Payment of the shortfall in apportionment;
    • Other necessary expenses.
  4. Policy on Refund & Cancellation:
    • Yofo is an social protection platform. The Platform user may email us at policy@yofo.com to cancel the subscription within 7 days of enrolment. After that the refund would not be possible. Your mere browsing of our Website, showing interest to be a member does not create any contractual right/obligation whatsoever unless and until you make the payment of price mentioned on Website. Further, we do not warrant the exact amount of compensation.

6. Termination of Yofo Mutual Aid Platform and Member Withdrawal

  1. As a registered member, you have the following rights and obligations:
    • Yofo Mutual Aid Company terminates the operation of Yofo Mutual Aid Platform;
    • The Yofo Mutual Aid Platform is terminated due to force majeure, laws and regulations, policy factors, etc.
  2. When any of the following situations occurs, you will exit the Yofo Mutual Aid Platform:- You have violated national laws, administrative regulations, membership conventions, mutual aid plan terms, or various articles of association, rules and systems issued by the Yofo platform, and the Yofo platform decides to terminate the service for you;
  3. You do not agree to accept the amendments to the membership agreement, the terms of the mutual aid plan, or the various articles of association, rules and systems issued by the Yofo mutual aid platform;
  4. You do not meet the membership requirements stipulated in the membership agreement;
  5. You voluntarily exit the Yofo Mutual Aid Platform;
  6. The Yofo Mutual Aid Platform is terminated.

7. Member information processing and protection

  1. As a registered member, you have the following rights and obligations:
    • During the process of your application or use of Yofo Mutual Aid Platform services, the information you submit to Yofo Mutual Aid Platform or newly generated member information;
    • In order to meet the requirements of network real-name system management, provide you with services of the Yofo mutual aid platform and provide service status notification and query services, the Yofo mutual aid platform needs to collect your identity information and contact information stored on the Yofo mutual aid platform, including but not limited to: platform Account number, name, ID number, contact information, etc.;
    • In order to prevent risks and protect the legitimate rights and interests of you and other members, you agree that Yofo Mutual Aid Platform will provide legally retained member information to third-party organizations (including but not limited to: affiliated companies of Yofo Mutual Aid Platform, medical institutions, government agencies, etc.) or collect member information related to Yofo Mutual Aid Platform services through public channels. For example: when you initiate a mutual aid application, the Yofo mutual aid platform may need to verify your health information with relevant medical institutions. Yofo Mutual Aid Platform promises not to collect information irrelevant to Yofo Mutual Aid Platform services;
    • Before you provide other personal information to Yofo Mutual Aid Platform during the process of applying for or using the Yofo Mutual Aid Platform service (for example: you apply to join Yofo Mutual Aid Platform on behalf of others), please make necessary notifications to relevant individuals in advance (including but not limited to: Not limited to: information scope, information use, etc.), and obtain the consent of the relevant individual.
  2. You agree that the Yofo platform will process and protect your personal information in accordance with the “Privacy Policy”. Please read this policy carefully, and if you have any questions, please feel free to contact Yofo Mutual Aid Platform. The content of this agreement also includes the "Privacy Policy", which is an integral part of this agreement. Your acceptance of this agreement is deemed to be your acceptance of the "Privacy Policy".

8. Disclaimer

  1. You agree that the Yofo Mutual Aid Platform will follow the principles of legality, legitimacy, and necessity, and collect member information related to the services of the Yofo Mutual Aid Platform in the following ways:
    • During the process of your application or use of Yofo Mutual Aid Platform services, the information you submit to Yofo Mutual Aid Platform or newly generated member information;

  2. You agree that the Yofo platform will process and protect your personal information in accordance with the “Privacy Policy”. Please read this policy carefully, and if you have any questions, please feel free to contact Yofo Mutual Aid Platform. The content of this agreement also includes the "Privacy Policy", which is an integral part of this agreement. Your acceptance of this agreement is deemed to be your acceptance of the "Privacy Policy".

9. Jury system

  • Yofo Mutual Aid Platform can formulate additional jury review rules according to operational needs. Such rules become an integral part of the membership agreement after publication, and have the same legal effect as the membership agreement. The review results of the jury are a manifestation of the will of all members, and you should accept and respect them.

  • Yofo Mutual Aid Platform is exempt from liability when it is unable to provide you with mutual assistance services due to the following circumstances:
    1. System shut down for maintenance or upgrade;
    2. The telecommunications equipment on which the Yofo Mutual Aid Platform relies fails;
    3. Due to force majeure reasons such as typhoons, earthquakes, tsunamis, floods, lightning, power outages, wars or terrorist attacks, strikes, etc.;
    4. Your computer software, system, hardware, communication lines, and power supply lines fail;
    5. You have improperly operated or used the Yofo Mutual Assistance Service in an unauthorized or unapproved manner;
    6. Due to virus, Trojan horse, malicious program attack, network congestion, system instability, system or equipment failure, communication failure, bank reasons, third-party service defects or government actions, etc.;
    7. Other reasons not attributable to Yofo Mutual Aid Platform.
    8. If your claim is rejected you may apply for revaluation, but the jury’s decision on that will be final, Yofo, as a platform will not be legally liable for anything in case the claim is rejected.
    9. If the claimant has lied about any of the pre-existing health issues/age/genetic condition, Yofo has the right to terminate these account and reject those claims.
    10. Yofo may increase/decrease the membership cost and compensation value at any point of time depending on number of participants and the final compensation value will be proportional to the number of funds and amount Yofo has as a platform will not be legally liable for any claim rejection which is independently evaluated by the Jury.

10. Application of Law and Dispute Resolution

  1. Indian laws shall apply to the conclusion, implementation, interpretation and dispute resolution of the Membership Convention. User understands that this is a new model of social protection and we can change the terms and conditions accordingly as the platform grows.
  2. All disputes related to or arising from membership conventions and mutual assistance events should only be resolved through friendly negotiation; if the negotiation fails, either party should submit the dispute to the Jury and Mentors appointed and their verdict would be final in those circumstances.
